Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the website cairnsplatecraft.com (the “Site”) operated by Cairnsplatecraft (“we”, “us”, or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
These Terms are governed by the laws of Victoria, Australia, and, where applicable, the laws of the Commonwealth of Australia. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) or any other applicable law that cannot be excluded.
1. About Cairnsplatecraft
Cairnsplatecraft provides catering services for corporate, wedding, private, and cocktail events in Melbourne and surrounding areas. Our business address is 28A Millers Rd, Brooklyn VIC 3012, Australia. You can contact us by phone on +61 3 7050 4556 or by email at cairnsplatecraft@hotmail.com.
2. Use of the Site
You may use the Site for lawful purposes only. You agree not to violate applicable law; attempt unauthorised access; disrupt Site security or operation; transmit malware or spam; scrape the Site without consent; commercially exploit content without permission; or misrepresent your identity in enquiries. We may suspend access for breach, maintenance, security, or legal reasons.
3. Enquiries and bookings
Submitting an enquiry through the Site does not create a binding catering contract. Quotes, menus, package descriptions, and availability information provided on the Site or in response to an enquiry are indicative unless confirmed in a written booking agreement, proposal acceptance, or invoice terms issued by us. Final pricing may vary based on guest numbers, menu selections, staffing, equipment, venue conditions, travel, and event timing.
Where a booking is confirmed, the specific commercial terms (including deposit, cancellation, menu finalisation dates, and payment schedule) will be set out in the booking documents provided to you. In the event of inconsistency between these website Terms and a signed booking agreement, the booking agreement prevails for that event engagement.
4. Intellectual property
Unless otherwise stated, all content on the Site — including text, graphics, logos, photographs, layout, and design — is owned by or licensed to Cairnsplatecraft and is protected by Australian and international intellectual property laws. You may view and print reasonably sized extracts for personal, non-commercial use, provided you do not modify the content and retain any proprietary notices. You must not copy, adapt, distribute, publicly display, or create derivative works from Site content without our prior written permission.
5. Accuracy of information
We take reasonable care to keep Site information accurate and current. However, menus, package prices, service descriptions, images, and availability may change without notice. Photographs are illustrative of style and presentation and may not depict the exact dishes prepared for every event. You should confirm all material details with us before relying on them for planning decisions.
6. Third-party links and social platforms
The Site may include links to third-party websites and social media platforms, including Instagram, Facebook, WhatsApp, and Viber. These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party platforms is at your own risk and subject to their terms.
7. Privacy
Our handling of personal information is described in our Privacy Policy and Cookie Policy. By using the Site, you acknowledge that personal information you submit may be processed in accordance with those policies.
8. Disclaimer
To the maximum extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. Where the ACL or other law implies warranties or guarantees that cannot be excluded, our liability for breach of those guarantees is limited, at our option and where permitted, to resupplying the relevant services or paying the cost of having the services supplied again.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or pure economic loss arising from Site use, including loss of profits, data, or goodwill. Our aggregate liability for Site use is limited to AUD $100, except where liability cannot be limited by law.
10. Indemnity
You agree to indemnify Cairnsplatecraft against claims and expenses arising from your misuse of the Site, breach of these Terms, or infringement of third-party rights, except to the extent caused by our negligence or wrongful act.
11. Food allergen and dietary notice
The Site does not provide medical or allergen advice. Severe allergies should be discussed during booking. Cross-contact risks may exist in shared kitchens.
12. Changes to the Site and Terms
We may update the Site or these Terms at any time by posting changes on this page. Continued use constitutes acceptance to the extent permitted by law.
13. Severability and waiver
Invalid provisions will be read down or severed; remaining Terms continue. Failure to enforce a right is not a waiver.
14. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia. Subject to non-excludable consumer rights, disputes are subject to Victorian and Commonwealth courts. Please contact us first to resolve concerns in good faith.
